A&E’s Storage Wars Puts Spotlight on California Self-Storage Facility Laws

Storage Wars is a widely popular reality TV series, currently in its second season on the A&E Network. It is in fact A&E’s best series of all time among adults between 25 and 54-years-old. The show follows professional bidders or auction hunters as they search Southern California for storage units with merchandise that they may profit from. The former owners of the stored property have lost any claim to it after not paying their storage fees. The bidders base their bid solely on a five-minute window in which to inspect the contents up close and also viewing the contents from the open door of the storage unit.

The value of Storage Wars is not just the fun factor of finding treasures in random storage units and trying to outbid each other. It also gives us a peek into California’s self-storage laws. Few people know that the Business and Professions Code of California includes the “California Self-Service Storage Facility Act,” which guides general business practices for self-storage facility owners, including liens on storage property.

According to section 21702 of California’s Business and Professions Code, “The owner of a self-service storage facility … [has] a lien upon all personal property located at a self-service storage facility for rent, labor, late payment fees, or other charges, present or future, incurred pursuant to the rental agreement and forexpenses necessary for the preservation, sale, or disposition of personal property…”. If a self-storage renter does not pay the fees required in their rental agreement for 14 consecutive days, the owner can send notice of impending termination of their use of the storage unit. If the issue of payment continues to go unresolved, the storage property owner may see their unit on the next episode of Storage Wars.
